PHARMIGO TERMS OF USE

PLEASE READ THESE TERMS OF USE CAREFULLY, AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS, INCLUDING DISCLAIMERS, LIMITATIONS, AND EXCLUSIONS OF OUR LIABILITY AND LIMITATIONS AND WAIVERS OF YOUR RIGHTS AND REMEDIES. THIS PLATFORM IS FOR OVER-THE-COUNTER MEDICATIONS ONLY AND DOES NOT PROVIDE PRESCRIPTION SERVICES. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, YOU SHOULD CALL 911 IMMEDIATELY OR ATTEND THE EMERGENCY ROOM OF THE NEAREST HOSPITAL.

1. Your Agreement to Terms of Use

The following terms of use (the "Terms of Use") govern your access to and use of our mobile applications, including the Pharmigo application (the "Apps"), our website, software platforms, and all other services provided by us (collectively, the "Platforms"). The Platforms operate to connect you with over-the-counter medication delivery services and to provide supportive tools in managing your wellness needs (the "Services").

These Terms of Use form an agreement between Pharmigo Inc. ("Pharmigo", "us", "we", "our") and you. The term "you" refers to the person or entity browsing, installing, downloading, accessing or otherwise using the Services.

BY USING THE SERVICES, YOU: (A) REPRESENT AND WARRANT THAT YOU HAVE THE CAPACITY TO ENTER INTO BINDING OBLIGATIONS; (B) REPRESENT THAT YOU ARE AT LEAST 18 YEARS OF AGE; AND (C) AGREE TO BE BOUND BY AND COMPLY WITH THESE TERMS OF USE.

2. Modifications

Pharmigo reserves the right to amend, modify, restate, replace, or supplement these Terms of Use at any time. You should review these Terms of Use regularly. By continuing to use the Platforms after any changes, you agree to be bound by the updated Terms of Use. If any amendment is not acceptable to you, you must immediately cease using the Platforms and Services.

3. Content

The Platforms contain content provided by Pharmigo and third parties, including product information, articles, pictures, videos, and other materials (the "Content"). This content is for informational purposes only and does not constitute medical advice.

4. User Account

To access certain features and place orders, you may be required to create a user account with username and password credentials (the "User ID"). You must keep your User ID secure and not share it with others. We reserve the right to disable any User ID at any time in our sole discretion.

5. Your Responsibilities

  • Comply with all applicable laws and regulations
  • Use reasonable efforts to prevent unauthorized access to your account
  • Keep login information confidential
  • Monitor all activity on your account
  • Promptly notify us of any suspected unauthorized activity or security breaches
  • Provide accurate and complete information when creating your account and placing orders

6. OVER-THE-COUNTER MEDICATIONS ONLY

PHARMIGO ONLY SELLS OVER-THE-COUNTER (OTC) MEDICATIONS AND HEALTH PRODUCTS. WE DO NOT SELL PRESCRIPTION MEDICATIONS OR PROVIDE MEDICAL ADVICE. THE CONTENT AND PRODUCTS ON OUR PLATFORM SHOULD NOT BE USED AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS CONSULT WITH A HEALTHCARE PROVIDER BEFORE STARTING ANY NEW MEDICATION OR TREATMENT.

IF YOU HAVE A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY OR GO TO THE NEAREST EMERGENCY ROOM. DO NOT USE OUR PLATFORM FOR MEDICAL EMERGENCIES.

7. OTC MEDICATION DELIVERY SERVICES

All the deliveries and medicines are fulfilled by third party delivery partner companies and pharmacies.

Our services include:

  • Product selection and ordering through our platform
  • Pay-on-delivery options for eligible orders
  • Home delivery of OTC medications and health products from third party or pharmacies
  • Customer support for order-related inquiries

IMPORTANT DISCLAIMERS:

  • All products sold are over-the-counter medications that do not require a prescription
  • We verify age requirements for certain products as required by law
  • Delivery times may vary based on location and product availability
  • We reserve the right to refuse or cancel any order at our discretion
  • Some products may have quantity limits or purchase restrictions

8. Payment Methods and Pay-on-Delivery

Standard Payment Methods

You may pay for orders using credit cards, debit cards, or other accepted payment methods. We use secure third-party payment processors and do not store your complete payment information.

Pay-on-Delivery Service

For eligible orders and locations, we offer pay-on-delivery service where you can pay cash or card upon receipt of your order. Pay-on-delivery terms:

  • Available for orders within designated delivery areas
  • Subject to order value limits and product restrictions
  • Requires verification of delivery address and contact information
  • Orders may be subject to additional verification requirements
  • We reserve the right to discontinue pay-on-delivery service for any customer or location

You acknowledge and agree that:

  • You are responsible for having payment ready upon delivery
  • Failed delivery attempts due to unavailable payment may result in additional fees
  • Pay-on-delivery orders may have longer processing times
  • We may require verification of identity upon delivery

9. Age Verification and Restrictions

Certain products require age verification. By ordering such products, you confirm that you meet the minimum age requirements. We reserve the right to request identification upon delivery for age-restricted products.

10. Product Information and Availability

Product information, descriptions, and prices are subject to change without notice. We make reasonable efforts to ensure accuracy but do not warrant that product descriptions or other content is accurate, complete, or current. Products are subject to availability and we reserve the right to limit quantities or discontinue products.

11. Returns and Refunds

Due to health and safety regulations, we generally cannot accept returns of opened medication or health products. Unopened products may be eligible for return within specified timeframes. Contact customer service for return authorization.

12. Prohibited Uses

You may not use our Services to:

  • Purchase products for resale without authorization
  • Provide false information during account creation or ordering
  • Attempt to circumvent age verification or quantity limits
  • Use the platform for any illegal purposes
  • Share your account credentials with others
  • Interfere with platform security or functionality

  • THE PLATFORMS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE"
  • WE MAKE NO WARRANTIES REGARDING ACCURACY, COMPLETENESS, OR RELIABILITY OF CONTENT
  • WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE OR UNINTERRUPTED
  • PRODUCT INFORMATION IS PROVIDED FOR REFERENCE ONLY AND SHOULD NOT REPLACE PROFESSIONAL MEDICAL ADVICE
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE

14. LIMITATION OF LIABILITY

  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM
  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • WE ARE NOT LIABLE FOR DAMAGES ARISING FROM YOUR USE OF PRODUCTS PURCHASED THROUGH OUR PLATFORM
  • THE EXISTENCE OF MULTIPLE CLAIMS WILL NOT INCREASE OUR MAXIMUM LIABILITY

15. Indemnity

You agree to indemnify and hold harmless Pharmigo from any claims, damages, or expenses arising from:

  • Your use of our Services or products
  • Your breach of these Terms of Use
  • Your violation of any laws or third-party rights
  • Any false information you provide

17. Governing Law

These Terms of Use are governed by the laws of Manitoba and applicable federal laws. Any disputes will be resolved in the courts here.
